Fukushima Update: Prosecutors Look To Put ex-Tepco Executives In Jail For Years

It's estimated that the cost associated with cleaning up the Fukushima nuclear disaster that took place back in 2011 might be as high as ¥70 trillion. It's been years now and they are still struggling to clean the area, radioactive water still spills into the ocean as we speak.

A class-action lawsuit previously determined that both the government and Tepco were liable; their negligence caused the meltdowns.

They were at fault because the court determined that they had failed to take the necessary preventative measures against the tsunami. Both the state and Tepco have been ordered to pay millions in damages.

Former Tepco executives have gone to trial and plead not guilty to professional negligence.

Now, prosecutors in Japan are seeking 5 year prison terms for those former executives as a result of their failure to prevent the disaster that took place.

They might not have been able to prevent the incident from occurring, though courts have determined that they should've been able to foresee it.

A final hearing for the defense is expected to take place in March this year. Prosecutors argue that it would have been easy to safeguard against a potential tsunami and they say that those executives should've known the risks that a tsunami might have posed.

The prosecutors have suggested that because the executives had failed to prepare adequately that it resulted in the deaths of many people.

Those executives who are now facing a few years behind bars have plead not guilty and they are arguing that they couldn't have predicted the tsunami, despite several courts now ruling that both the government and Tepco are liable for the damages that occurred as a result of the tsunami.

I never thought that the Tepco people should be demonized in the way they have. How do you foresee that kind of cataclysm? I mean, there was some negligence and I guess there's always a CHANCE that a 7.6 earthquake will cause a 35 foot wave RIGHT in front of your nuclear power plant, but it just seems so unlikely. Every single failsafe failed. The wave was bigger than their 30 foot wall and the earthquake was bigger than they anticipated. Every accident is hypothetically avoidable, it's just that reality gets in the way.

the investigation found that they had fault in their safety standards and emergency procedures, that the "root causes" of the problem were centered around the organizational & regulatory systems..

"[All parties] failed to correctly develop the most basic safety requirements - such as assessing the probability of damage, preparing for containing collateral damage from such a disaster, and developing evacuation plans for the public in the case of a serious radiation release."

"Had there been a higher level of knowledge, training, and equipment inspection related to severe accidents, and had there been specific instructions given to the on-site workers concerning the state of emergency within the necessary time frame, a more effective accident response would have been possible... Sections in the diagrams of the severe accident instruction manual were missing."

Hindsight is 20/20. I just don't buy it. Every disaster could be "avoided" had x and y been done. There were safety measures in place. Lots of them. It's just that nobody really thought it was going to happen. I think the report also says that there was only a 20% chance of this kind of potentiality within 30 years? At those odds, I'd bet against nature too.

Also, the court said something like they didn't like that they chose cost over safety. How asinine. People and companies make that calculation every day of every year. It's part of the job.

it isn't about avoiding it it's about finding liability for the damages and determining if their actions in any way worsened the damage for victims.. which multiple courts have concluded was the case. 👍

I guess. Seems like nobody is really "at fault" here, so liability seems moot. It's not like the Chernobyl explosion where staff were clearly at fault.

It still shocks to to today how unaware people are of the devastation Fukushima is still causing. This is the worst disaster of the century try if not longer. The media have kept this under wraps as our seas are being destroyed 💯🐒

I cringe at humanity when I think of the irreparable damage caused to the ocean and planet because of the fallout. Sure you can’t stand against the fury of nature and power of a tsunami but leaving it in hindsight and claiming nothing could have been done is gross negligence.

A nuclear plant on the edge of an ocean just doesn’t seem to be wise.

I suppose a prison term could serve as an example for other executives. I also imagine $ speaks and they will serve up some fall guys so that the real architects of this disaster are safe from a years of minimum security all inclusive resorts.
