Different point of views

Users Eva and nutela are in a discussion about the EOS community. User Eva thinks people need to get a more practical approach. She states ‘There are so many people who have different beliefs and philosophies in the EOS community. A lot of people put a lot of effort into fighting wars to have their philosophy or theory be fully catered for and others excluded. Why is it so hard to accept that in a worldwide community for trade there are a multitude of different beliefs and probably all have their place somewhere. If we want to have business and trade happening we have to be able to deal with most of them.’

The discussion between Eva and nutela goes on for a while.

Constitution

User Emma replies to user Jun (who talked about trust-minimization). She thinks that what is being implied is that the EOS constitution should protect against human overreach since the trustless system came into existence and in spite of the constitution. ‘This was one of the reasons a constitution of positive rights was suggested earlier. If you need a social contract for a trustless system to function appropriately, then the system is no more trustless. Hence, the suggestion to minimize our trust of BPs is on point. The constitution should be aimed at identifying and rejecting any entity that purports to represent popular will or to speak for the community. Popular will is the majority decision of token-holders as required by the EOS.IO software.’

User Samupaha replies to user Jun who replied to Samupaha’s blog the day before. (https://medium.com/@Samupaha/how-to-understand-dispute-resolution-in-eos-48552a6e381f ) User Jun had some comments about the blog. User Samupaha replies to those comments. After that user Todor asks ‘What happens if someone doesn’t sign this special transaction? Can they still transfer their tokens and interact with contracts?’ User Samupaha: ‘Nope, then the can’t use the blockchain. If they don’t want to sign the contract, they are explicitly saying that they don’t want to follow the rules. I don’t think we should have that kind of people in the ecosystem, that just creates more problems.’

After this the channel bursts into a discussion about constitution, people forcing people to submit to rules and (honest) scams.
At some point user Jetse Sprey (EOS - Amsterdam) says: ‘So all of these examples make clear we shouldn't try and define what an honest dApp is all about. We don't want to regulate on the dApp layer (nor on the base layer) That'll be done by local jurisdictions. As in our charter.’ User Sun Tzu says that there’s never a need to define these things up front. If there is a dispute it can be resolved in dispute resolution.

User Thomas Cox: ‘If anybody wants to cling to ‘code is law’ on EOS and we all agree to do these things according to the rules of the Constitution, that’s great, but if you disavow the Constitution, that doesn’t give you MORE leverage to stop the rest of us from following it, it gives you LESS. The code lets us do these things, therefore these things are lawful, according to ‘’code is law’’ thinking.’

Hack

User Sun Tzu: ‘Apparently a game got hacked because it was using a dodgy predictable random number. Is this a case of ‘’intent of code is law’’ because they used a number guesser that was guessed? Or is it a case of hacking where the contract was breached and a cause exists under the C? (Hypothetical question)
User Samupaha states that they were able to fix it themselves, so with Dan’s C, no interference by BPs would be necessary. User Justin Buck: ‘Also by Dan’s C, there is no recourse for those who lost funds.’
User Tanish: ‘What’s your point and what could ECAF have done?’
User Sun Tzu says that ECAF can hear a dispute as always. But he wonders what the dispute is. ‘That someone predicted a number based on prior blocks? But the blocks are public and so is the algorithm so how can the game use this as a secret?’ He then says that using code that allowed reentrancy is very dodgy. But someone did it, lost a lot of money, and it was considered a system bug that wasn’t spotted. ‘How to unravel the claims and counterclaims? Is this a NEED for dispute resolution, or is this a need for code is law?’
User Emma: ‘Businesses lose money based on mistakes. This is a good example of events that require no intervention.’
User Justin Buck: ‘I would like to see this: DR forum helps devs of dapp get their money back from the people that exploited their code, BUT also bans that dapp and devs for X time.’

User Thomas Cox replies to user Jun. It boils down that he thinks Jun hasn’t read the Governed Blockchain paper written by Norton Rose Fulbright (http://www.nortonrosefulbright.com/knowledge/publications/167968/legal-analysis-of-the-governed-blockchain ). User Jun states that he will read it (again) and see how the arguments hold. After reading it his position still stands.

After this, the remainder of the day users Jun and Eva talk about both civil and common law as well as the constitution.
