I thought the SEC didn't get to decide what is or isn't a security?

Now people and projects are running for the hills because of the SEC security label.

These projects are being labeled securities by the SEC because they say so.

I thought the courts decided what was a security and what wasn't?!

The SEC can give their opinion, but the courts need to weigh in on this...
