Brief description of Perwakafan at Gampong Blang Pie

Before the authors examine the causes and practices of diversion of wakaf land use in Gampong Blang Pie Kecamatan Tanah Luas, the writer first examines the existence and amount of wakaf land in Gampong Blang Pie Kecamatan Tanah Luas. Based on the author's interview with the Secretary of Gampong Blang Pie until early December 2014 when the author interviewed the Gampong Secretary, the total number of wakaf land in Gampong Blang Pie amounted to 4 plots, in which the whole plot of wakaf land was garden land, rinciaanya as follows:

1. Land in the form of a wakaf garden from Zulkifli Tahir located in Dusun Trieng with a total area of ​​991 M2 adjacent to the garden of M. Daud in the south, the north with the land of Joseph's garden to the west with the land of T. Ramli and the east with the channel.
2. Wakaf garden land from Tgk. Ahmad, located in Trieng Hamlet with an area of ​​608 square meters, is adjacent to Ramuku garden land south, north with Syafii land west with Muchtar and east with Muhammad land.
3. Wakaf garden land from Buthok Lian located in Dusun Tgk. Dirimba with a total area of ​​1533 M2 bordered by T.M. Aaron to the south, north with Rashidin's land west with Muhardi and the east with the land of M. Yakob
4. Wakaf garden land from Tgk. Isaac located in Dusun Tgk. Buried with a total area of ​​905 M2 is bordered by Bahrensyah land south, north with Razali Ab western land with Maimun land and east with Gampong Blang Pie road.

Based on the interview result of the writer with Imum Gampong Blang Pie Tanah Luas Subdistrict, it can be explained that the practice of perwakafan of land is still done traditionally where wakif still lack understanding about the rules that have been set by the government as the basis to get legal protection for the land which they wakafkan so in the implementation no representation practice is to make a letter and pledge it in front of the Head of Religious Affairs Office of the Sub-District as Officer of Deed of Waq Deed (PPAIW).

According to Imum Gampong Blang Pie, for the people of Gampong Blang Pie, wakaf is only a religious activity without understanding that wakaf is a legal event. Therefore, in practice, they also do not follow the procedures set by the government, but only pledge waqf before Nazhir and witnesses without any written evidence.

In general, many people who do not know the procedure perwakafan, as submitted by Tgk. Syamsyuddin as the secretary of Nurul Iman Gampong Blang Pie Mosque, who knows the procedure perwakafan only Nazhir and witnesses who receive wakaf only, other than that for other people know it only to know that the land has been ditwakafkan for the mosque. In order to create legal certainty, to avoid future disputes and to maintain orderly administration, the mosque construction committee has taken care of the Waq Deed (AIW) for all the wakaf land belonging to Nurul Iman Mosque to the Office of Religious Affairs of Tanah Luas Subdistrict and is now awaiting the completion process Deed of Pledge of Waqf to further take the certificate to National Land Agency (BPN).

Deskripsi Singkat Perwakafan di Gampong Blang Pie

Sebelum penulis meneliti penyebab dan praktik pengalihan pemanfaatan tanah wakaf di Gampong Blang Pie Kecamatan Tanah Luas, terlebih dahulu penulis meneliti keberadaan dan jumlah tanah wakaf di Gampong Blang Pie Kecamatan Tanah Luas.

Berdasarkan wawancara penulis dengan Sekretaris Gampong Blang Pie sampai awal Desember 2014 ketika penulis mewawancarai Sekretaris Gampong, jumlah keseluruhan tanah wakaf di Gampong Blang Pie berjumlah 4 petak, dimana keseluruhan bidang tanah wakaf tersebut berupa tanah kebun, rinciaanya sebagai berikut :

1. Tanah berupa kebun wakaf dari Zulkifli Tahir yang terletak di Dusun Trieng dengan luas keseluruhan 991 M2 berbatasan dengan kebun M. Daud disebelah selatan, sebelah utara dengan tanah kebun Yusuf sebelah barat dengan tanah T. Ramli dan sebelah timur dengan saluran.
2. Tanah kebun wakaf dari Tgk. Ahmad yang terletak di Dusun Trieng dengan luas keseluruhan 608 M2 berbatasan dengan tanah kebun Ramulah sebelah selatan, sebelah utara dengan tanah Syafii sebelah barat dengan tanah Muchtar dan sebelah timur dengan tanah Muhammad.
3. Tanah kebun wakaf dari Buthok Lian yang terletak di Dusun Tgk. Dirimba dengan luas keseluruhan 1.533 M2 berbatasan dengan tanah kebun T.M. Harun sebelah selatan, sebelah utara dengan tanah Rasyidin sebelah barat dengan tanah Muhardi dan sebelah timur dengan tanah M. Yakob
4. Tanah kebun wakaf dari Tgk. Ishak yang terletak di Dusun Tgk. Dirimba dengan luas keseluruhan 905 M2 berbatasan dengan tanah Bahrensyah sebelah selatan, sebelah utara dengan tanah Razali Ab sebelah barat dengan tanah Maimun dan sebelah timur dengan jalan Gampong Blang Pie.

Berdasarkan hasil wawancara penulis dengan Imum Gampong Blang Pie Kecamatan Tanah Luas, dapat dijelaskan praktik perwakafan tanah masih dilakukan secara tradisional dimana wakif masih kurang memahami mengenai aturan-aturan yang telah ditetapkan oleh pemerintah sebagai dasar untuk mendapatkan perlindungan hukum bagi tanah yang mereka wakafkan sehingga dalam pelaksanaan praktik perwakafan tidak ada yang membuat surat dan mengikrarkannya di depan Kepala Kantor Urusan Agama Kecamatan sebagai Pejabat Pembuat Akta Ikrar Wakaf (PPAIW).

Menurut Imum Gampong Blang Pie, bagi masyarakat Gampong Blang Pie, wakaf hanya merupakan suatu aktifitas ibadah tanpa memahami bahwa wakaf merupakan suatu peristiwa hukum. Oleh karena itu dalam praktek perwakafan juga mereka tidak mengikuti prosedur yang telah ditetapkan pemerintah, tetapi hanya mengikrarkan wakaf dihadapan Nazhir dan saksi-saksi tanpa adanya bukti tertulis.

Secara umum banyak masyarakat yang tidak tahu prosedur perwakafan, sebagaimana disampaikan oleh Tgk. Syamsyuddin selaku Sekretaris pengurus Mesjid Nurul Iman Gampong Blang Pie, bahwa yang mengetahui prosedur perwakafan hanya Nazhir dan saksi-saksi yang menerima harta wakaf saja, selain itu bagi masyarakat lain mengetahuinya hanya sebatas tahu kalau tanah tersebut sudah diwakafkan untuk Masjid. Untuk terciptanya kepastian hukum, menghindari sengketa di masa depan dan terbinanya tertib administrasi, maka pihak panitia pembangunan Masjid telah mengurus Akta Ikrar Wakaf (AIW) untuk semua tanah wakaf milik Masjid Nurul Iman ke Kantor Urusan Agama Kecamatan Tanah Luas, dan sekarang sedang menunggu proses selesainya Akta Ikrar Wakaf untuk selanjutnya mengurus sertifikat ke Badan Pertanahan Nasional (BPN).
