Under Section 14A of the Foreigners Act, 1946, the Indian authority can jail foreigners who enter the country without proper documents for 2-8 years.

Under this Act, according to the latest publicly available data as of April 1, 2016, there are 3,647 Bangladeshi adults and 142 Bangladeshi children in the jails of West Bengal. Out of 4,097-km porous border between India and Bangladesh, 2,217 km lie in West Bengal.

In smaller states in the north-eastern region, the Bangladeshis have become the majority to the extent that they have successfully put up their political candidates. Tripura, originally a non-Bengali state, is an example of where the Bengalis, who came from Bangladesh, have outnumbered the native inhabitants.

It is interesting to note that the non-Bengali states have over the decades become a Bengali majority or near majority state with Tripura and Assam as prime examples, whereas West Bengal (Bengali state or homeland) has imprisoned other Bengalis.
