The decrees implementing this flagship measure of the law "Avenir professionnel" are not yet published, contrary to what some media have announced. They should be on July 1st. In the meantime, some employees have been misled.

It is not yet possible to touch unemployment after a resignation in case of professional retraining or business start-up, as provided for by the "Professional Future" law, adopted last summer, taking up one of the major campaign promises of Emmanuel Macron .

So why this imbroglio? Simply because, contrary to what was originally planned ... the implementing decrees for this measure have not yet been passed. "The government had indeed announced that this new right would be available from 1 January 2019, but that is not the case. We must discuss it again next January 15, as part of the negotiations we are conducting around unemployment insurance, "said Denis Gravouil, the negotiator of the CGT.

Solicited by us, Pôle emploi recalls, for its part, that the decree which should allow to set the "conditions of recognition (...) of the real and serious character of the project of professional reconversion" of the resister wishing to receive unemployment benefits has a "publication envisaged in March 2019", according to what the site Légifrance . But nothing allows, either, Pôle emploi to certify that the decree will be published well in time, especially if the social partners can not find an agreement on unemployment insurance, in which case, the government will resume the hand.

This is probably why the cabinet of the Minister of Labor, Muriel Pénicaud, tells us that the measure should finally be "in place on July 1".
