Jury Expected To Deliver Verdict On Monsanto Case Any Day Now

in #monsanto5 years ago

One man from Sonoma, Edwin Hardeman, is one of thousands of victims who have claimed that Roundup weed killer had caused their cancer. He has been in court recently, pursuing that legal battle against Monsanto in San Francisco, and this trial could set precedent if the jury eventually decides to side with Hardeman and rules that Roundup had caused his non-Hodgkin lymphoma. The jury is expected to deliver their verdict on the case any day now.

Hardeman, according to his lawyer, had a great deal of exposure to Roundup, using it regularly for more than 26 years.

This is reportedly the 2nd Roundup lawsuit that has gone to trial in the country, while there are thousands of more cases waiting to have their day in court as well.

Previously, a court awarded one man from California hundreds of millions of dollars after the jury decided that Roundup had contributed to his cancer. However, that reward has since been drastically reduced and that case is still on appeal.

Recent court documents also reveal a great extent to which Monsanto tried to fight the stigma surrounding glyphosate and the negative assessments that had arisen that questioned the safety of the product. They allegedly sought to hire scientists that would specifically publish studies that would defend glyphosate and some of those studies had also allegedly been reviewed by Monsanto prior to their publication.

If the jury in the current case in San Francisco decides that the Roundup did cause his cancer, the trial is then expected to proceed to a second phase where lawyers will seek to prove the various ways that Monsanto had attempted to influence regulators, scientists, and the public about the safety of their products.

Bayer continues to deny any allegations that Roundup might contribute to the cancer that tens of thousands say they have developed as a result of regularly using Monsanto products. That second phase of the trial is also expected to determine what, if any, liability Monsanto had and what potential financial damages there might be as a result.

There are still thousands of similar cases that have been brought against Monsanto, with many people waiting to still have their day in court.

The judge who is overseeing this current case with Hardeman is Judge V Chhabria who according to a report from U.S. Right To Know, allegedly used to work for a law firm that represented and defended Monsanto. Some have questioned whether or not he might be dishonestly in favor of the defense because of it; if that history plays any issue with the possibility of impartiality.

At one point the plaintiff's attorney had to pay a $500 fee for angering the judge during her opening statement. That move allegedly triggered a great deal of feedback; criticism from other lawyers, along with encouragement and support from a myriad of other individuals, who expressed their outrage with the judge's actions.

Because of the judge's past, it's only natural for people to assume or wonder if that there might be an issue with bias, the judge being favorable to one side, and so people have been surprised by the little victories that they have seen so far for this case.

"If we are able to succeed here then it really sends a signal to Monsanto and specifically to Bayer that they have a real problem," - Hardeman's attorney, Brent Wisner

Well my farmer buddy Butch is not a big fan of theirs. It was kind of confusing but he told me years ago that certain seeds are are not effected by Roundup. Of course these are like patented. Now if they found you had some in your field that were not purchased with the patented protection, Monsanto would make your life a real hassle. Even if the seeds might have blown in or something. I know I am not telling it right coz it was years ago, but reading this brought it back to me. The main thing was not wanting to use the seeds, coz you cannot even save the seeds from the plants of the seeds you bought. The big issue was the private investigators always going around your place snooping lol.

that's very true, they've made millions from taking small farmers to court and suing them over their seed patents

Wow. I didn't know very much about the RoundUp even though I did use it few times, many, many years ago, but it would really not surprise me that it does create cancer etc. and I hope that these poor people who say they got cancer from using this product will have their justice and finally show the world the truth about Monsanto and Bayer and that no matter how big these guys are, we people have to fight for our rights especially when it comes to our health.
Great post @doitvoluntarily and always so grateful and thankful for your amazing support.

thank you for stopping by! always apprec it🙏

Wow, Roundup is one of the weed killer drugs that are widely used by farmers in Aceh, Indonesia ... and it turns out it can cause cancer, I just found out now, hopefully there is a review of the safety of this plant fertilizer so as not to disturb human health, I also hopes that Mansanto will not be punished by a judge, but scientists must be more vigilant in creating agricultural medicines by minimizing the danger posed..

Thank you for your information, friend.
I will tell friends to be careful with this weed eradication drug.

I truly believe these chemicals cause cancer and who knows what else! This judge should not be overseeing this case. And I really hope he wins to set a peresidence for the thousands of people still waiting for their day in court!! im tired of these big money companys getting away with this shit as the little guy usually has no recourse!
Awesome post @doitvoluntarily , keep up the great work! upped earlier now resteemed! 👍😎

Hope justice does her job impartially..

The verdict will be telling. Let's hope none of the jurors have been bought off by Monsanto. Thanks for sharing.

I think someday roundup will be seen as the ddt of our time. How these corps can survive to maim and kill again and again is beyond me.

awesome :) thanks!

How many more cases do we need before they ban this chemical. I was so sad when Europe extentened the licence to sell roundup or glyphosate containing products.
