ORDER:
After perusal of report under Section 173 Cr.P.C and other related material, there are sufficient grounds to proceed against accused in this case, hence, charge under Section 9-B of CNSA, 1997 has been framed to which the accused pleaded guilty.
2 At this stage, it is made clear to the accused that why he should not be convicted in view of his confessional statement but he is still firm in his confessional statement and states that he is a poor man and repentant upon his act and assured this court to remain careful in future in case lenient view is taken against him. Moreover, the accused has been warned that he is not bound to make any such statement but he has repeated his stance that he has made his confessional statement voluntarily.
3 Keeping in view the aforementioned facts and circumstances since the accused has made confession voluntarily, therefore, he is liable to be convicted under section 9-B of CNSA, 1997, however, keeping in view the fact that the accused appears to be first offender, therefore, by taking lenient view, the accused is convicted under Section 9-B of CNSA, 1997 and sentenced to undergo one year imprisonment and fine of Rs.2000/- but for reformation of the accused instead of sending him in Jail, he is sent to probation under Section 5 of Probation of Offenders Ordinance, 1960 and he is directed to submit surety bond to the tune of Rs.50,000/- with one surety in the like amount to the satisfaction of Probation Officer for a period of one year to commit no offence, keep peace and show good behaviour during period of bond and to appear in respect of sentence if called upon to do so during that period. Accused be placed on probation and kept under supervision of Probation Officer for a period of one year. It is further directed that the accused shall abide by the conditions of the bond executed by him and that he will reside within limits as mentioned in said bond and shall not leave such limits without permission of Probation Officer. Case property shall be kept intact till the period of expiry of appeal/revision, if any. Fine paid. Fine be deposited in the Government Treasury.
4 Accused requested for time for submission of surety bond. In the circumstances, he is directed to submit surety bond on 17.10.2014.
5 As per the Reader a Clerk from the office of probation officer appeared who inspite of asking to wait for the purpose of filing of surety bond had disappeared. In the circumstances, the probation officer be summoned for the said date for performance of his duty.
