Politics: Rights Of A Citizen

Rights are privilege conferred by law upon a person or a group of persons. In other words, rights are privileges that every citizen enjoy in a country. Thus, each country confers certain rights on all its citizens and these rights are not absolute since they are limited by the rights of other citizens in the state.

The limitations are aimed at ensuring that citizens enjoy these rights equally, and that powerful or undisciplined citizens do not encroach on others' rights. Rights Of citizens are the just, legal entitlement and claims which are inalienable (cannot be taken away) to citizens of a state and which the government of a state has a duty to protect and guarantee. If these rights are invaded by another citizen or the government, the citizen is entitled to seek redress in the court of law.

In most countries of the world, these rights are usually written in their constitution and in Nigeria, it is entrenched in the constitution as the fundamental human rights of each citizen.

Classes of rights

Rights can be classified into two broad categories: Civil and Political rights.

Civil rights are created and protected by the state for its citizens and each citizen irrespective of their social and economy status are expected to enjoy these rights similarly with aliens but with a qualification.

These rights include:

  • Right to life:
    This can be regarded as the pinnacle of existence because no human soul has the right to eliminate his/her life or those of others. In other words, the state does not permit suicide or homicide for any of his/her citizen. The implication of this right is that no individual, group or even government has any right to take the life of a citizen. However, a person shall not be regarded as having been deprived of his life if he dies as a result of defence of any person from unlawful violence or for the defence of property belonging to the country.

  • Right to dignity of human person: Every citizen possesses the right to and respect for the dignity of his person. A citizen should not be subjected to torture or any other inhuman treatment. He should not be held in slavery or servitude and should not be required to provide forced or compulsory labor.

  • Right to personal liberty:
    Every citizen is entitled to his personal liberty. This right allows a person who has been arrested or detained to be brought before the court of law, two months from the date of his arrest or detention in the case of a person who is in custody or is not entitled to bail or three months from the date of arrest or detention in the case of person who has been released either unconditionally or upon such conditions dial are reasonably necessary to ensure that he appears for trial at a later date.

The best way to explain rights and the role of governments and the agencies is to point out that Governments are instituted among men to secure these rights.

From the declaration of independence.

The truth is that Governments cannot actually perform the function of securing a peoples rights because it always grows and that growth creates a power imbalance. A individual can only generate so much force and because a government multiply's its force by having more people than one man can take by himself Governing agencies will always have the power to abuse its purpose. Thus Governments and our agencies always will become corrupt.

The solution is support our Committee's of Safety and organize our selves. If just two percent of Americans did this. The corruption wouldn't have a chance.
