Apple can no longer sell its iPhone 7 and 8 in Germany
The iPhone 7/7 Plus / 8 / 8Plus are no longer available on the official German website of Apple, neinther in 15 physical stores of the brand in Germany. Nonetheless, the sale of the new iPhone XS/XS Max/XR which were launched in 2018 will not be impacted in a negative way. It’s worth mentioning that just one month earlier, the marketing of several iPhone models was already prohibited in China by Chinese legislation due to the patent infringement of the company Qualcomm by Apple.
Qualcomm is the world largest mobile chop manufacturer particularly known for developing and manufacturing chips connected to the network. Qualcomm licenses all of its researches and development patents as a whole, and licensing fees are based on the overall sales price of mobile devices. Qualcomm invoices license fees to any company that manufactures mobile network devices, even if they do not use Qualcomm-developed chips. But the subordinate chip makers are able to use Qualcomm's intellectual property without licenses expenses. Apple has been using Qualcomm's network connection chip for connecting cellular data. The, the issue is that Apple believes that Qualcomm's should only set a license fee for the Qualcomm chip used in mobile devices, rather than the entire phone.
Apple CEO Tim Cook said that Qualcomm's research and development on the network connection chip patent is very good. However, this technology has nothing to do with Apple's independent innovation display as Touch ID and other technologies of the iPhone. Therefore, Qualcomm’s lawsuit against Apple’s patent infringement filed with the court is irrelevant. Apple has already stopped paying license fees to Qualcomm since the April 2018.
The patent battle between the two companies has been going on for a long time. On December 20, 2018, the Court of Munich ruled that Apple infringed Qualcomm's smartphone energy-saving patent technology and asked Apple to stop selling infringing products in Germany.
