The appeals process begins for both Steven Avery and Brendan Dassey. First order of business? Sort out that screwy so called defense lawyer Len Kachinsky who seemed to be confused about whose side he was on. It is our constitutional right to have a loyal attorney and not have a coerced confession used against us.

Remember, Kachinsky is the guy who's first statement to the press about being assigned to Brendan was about how he just came in third place for an elected office. He was Brendan's attorney but seemed to have an obsession with Steven Avery, telling the media he was evil incarnate. He denied saying this on the stand so they played the tape. He did not meet or communicate with Brendan the day he was assigned to him. He was too busy talking to the press about his campaign and Steven. He told the press, "We have a 16-year-old who, while morally and legally responsible, was heavily influenced by someone that can only be described as something close to evil incarnate." On the stand he said, "that wasn't me.... That would in effect admit guilt and that is definitely something you should not say" They played the tape. The next day he said, "if the statement is valid and admissible as evidence it would almost certainly result in a conviction." This was before he reviewed Brendan's statement.

Kachinsky told the press Brendan was amenable to a plea as a way to "get the family used to the idea". He can't help mention it was in Brendan's best interest to not be a pawn of the Avery family, and admitting his involvement with the crime would be a part of that. WHAT? This obsession with Avery is obvious while any concern for his client is missing. Mind you, Brendan told him he didn't do it, his "confession" wasn't true and that he wanted to take a polygraph.

Enter Michael O'Kelly. Remember, this is Kachinsky's investigator that told Brendan to choose between "I am sorry" or "I am not sorry" for "what I've done". They find an email he wrote saying Brendan's testimony will bolster the prosecution's case against Avery. He's asked, "so your goal is not only to get a confession but also to gather evidence to help the state with its prosecution (again, against Avery)?" He replies, "that is correct." "Even if that evidence tends to inculpate Brendan?" O'Kelly, "yes, that's correct." Let's review, this is Brendan's defense lawyer's investigator! I tell you the amazeballs just keep coming in this series! There are several scenes of Kachinsky mingling with the police and Katz himself, they were basically working for them in their case against Avery no matter the damage to their client and said as much on the stand. I mean, amazeballs. What else can you say?

Not only is Brendan a client of Kachinsky's, but also O'Kelly. The confession O'Kelly gets from Brendan occurs in a room that is basically a shrine to Teresa. He is crying about Teresa on the stand. Further emails show him ruthlessy degrading the Avery's as some kind of incestuous sex fiends, pure evil. That their gene pool needs to end. Remember, that "confession" O'Kelly gets is given straight to Fassbender and Wiegert(F&B) so they can have another 3 1/2 hours alone with Brendan, without counsel present. They continue with their leading questions, Brendan denies his involvement but points to Steven to answer these questions because as F&B repeatedly point out, they already know what happened. Anyone who can't see Brendan is being played like a fiddle must hate bluegrass. If we haven't mentioned it yet for this episode Brendan is learning challenged, to be polite.

Kratz Bombshell

It is revealed Ken Kratz was sexting a domestic abuse victim whose case he was handling, a woman who was severely beaten. She said it was sexual harassment. Want some insight into the mind of Kratz? Here are some of the texts. "I am the attorney. I have the $350,000 house. I have the six-figure career. You may be the tall, young, hot nymph, but I am the prize." "Are you the kind of girl that likes secret contact with an older married elected DA.... the riskier the better?" When asked about it Kratz expresses concern over his reputation to the reporter. Reputation. This is the guy who tried and convicted Steven Avery at media conferences before his trial even started. At last 5 women came forward. He finally resigned.

Judge Fox, Brendan's original judge, denies Brendan's request for retrial.

Judge Willis, Steven's original judge, denies him as well. Same with State court of appeals. Same with the State supreme court.
