Most are on public property, placed with permission or with the hope of forgiveness... there are guidelines for placing on geocaching.com and recommend that you get the app for your phone once you have a login. There is a free app called c:geo that works great.
Your cache needs to be more that 530 feet from any other ones and can't be on Railroad right of ways, school property, or anywhere it might cause a bomb squad to be called...
Your coordinates need to be very accurate, finding some caches will help you figure out how accurate your cellphone is. And you get to write up a page for the cache on the website so other people will come out to find it. Another guideline is no self-advertizing or charity advertising on the cache page. That keeps people from creating them to advertise their business or trying to use them to raise money.
