[FamilyProtection] False Report: The Other Head Of The Coin

 My last POST stemmed from an interview I had with a Floridian Medical Practitioner about three months ago, it showed their(Genuine Health workers) own part of the story and how individual state laws mandates (compels) them to make report to CPS on "Suspected Abuse" that might not be abuse at all, but leads to investigation and removal nonetheless. The punishment attached to failure of doing as mandated in a State like Florida is Felony. If you would love to have an eagle-view on this matter, please check out my previous post as linked. 

For these supposedly Genuine mandated reporters(doctors, teachers, counselors, e.t.c), I believe within their heart they say to themselves, "It is better to report a case now in uncertainty and be wrong later, than to not report a case now and be charged for deliberately refusing to report". Well, I am not surprised by these laws and how loosed they can be, CPS issues hardly surprise me these days, you just have to brace yourself for the worst whenever an matter is related to them. If you had a Counselor friend who told you he or she was kicked out of the job and fined by the state after being accused of refusing to cooperate with DHS on a case relating to a child, please think twice before you disbelieve him or her (cause I did disbelief an acquaintance about 5 years ago).

A Question: Yes or No Answer

For child abuse reporters (not mandated workers only), does the law protect false reporters? Does the law make an explicit provision for the punishment of reporters who "willfully/deliberately" make false reports?. 

Answered Correctly?

If your Answer was a "Yes", you are correct, if it was a "No", you are absolutely correct as well. You don't have to overthink it though, check your State Statutes and you will understand it perfectly. I live in a State where after reviewing her Statutes, found that a deliberate false reporter in child protective case can be charged with misdemeanor, spending time in a jail for 6 months or fined or both. Have I seen this happen effectively?..I have NEVER!. 

Some states do not make provision in their respective Statutes that deal with the reporting of abuse, I presume they consider it as no issue. You would have to check your state statutes to know if there is any provision for punishing any false reporter, spelled out explicitly. If there is, who would give you the name of the false reporter?, CPS?. . 

A Deeper Look 

When it comes to mandatory reports, the law becomes very rigid and stern, meanwhile, when the table turns around, in matter of false reports, the statutes becomes a rubber-band, bendable in any form it can be.
You might want to ask, "why does CPS or the Court becomes nonrigid to take false report in family cases as a stern matter?". I believe this is the easiest question of them all, and the answer lies in the fact that CPS FEEDS OFF FALSE REPORTS!.

If the laws governing false reports were being implemented to its full extremes for everyone just as the Mandatory report laws are being implemented, the rate of report of child abuse or neglect would reduce far more than half of what we have now(conservative numbers).

How can CPS be weaponized by people who have a grudge, disapprove of your family, disapprove of your homeschooling practice if false reports where to be taken as serious as they are!. CPS wants to be weaponized, only that way can they get the number of children rolling in like a non-stop factory. Calls from ex girlfriends, angry co-worker, dubious grandmothers who want custody, wives who wants sole custody.......the list goes on and on. 

For example, an angry ex of a father who we helped some months back called CPS every now and then to make false reports, non of which checked out true, but kept on triggering new investigations from CPS every time. Why would caseworkers keep responding to complaints from the same old false reporters?. well, I think you do know.  

 Whether there be an explicit statute or not for false reporting, the salient truth remains; CPS encourages "ANY" report at all, they don't care if it is false or not, this is why they are ready to continuously answer the complaint of that "caller" who has called them on 7 different occasions already to crucify you.  How can CPS who steadily lies and falsify claims be concerned about false reports?.
