If there was something wrong with the road, maybe it's the fault of the people responsible for maintaining it - they should have known there could be someone hurt. If the road was bad because of poor quality asphalt, maybe it's the company who made the asphalt who is at fault. There is always someone to blame, or maybe sometimes accidents happen.
