Court Rules City Can't Stop Food Truck Competition

Food truck owners in various cities have been engaged in ongoing fights with bureaucrats, because they want the freedom to be able to compete in the market and many cities have established restrictions that prevent them from doing just that.

Food truck owners have launched a variety of lawsuits over this matter, arguing that their Constitutional rights are being violated and that these rules are discriminatory against their business.

In some instances, where those regions have already been sued over the restrictions, such as Carolina Beach, in North Carolina, they've had to reverse the prohibition and allow the food trucks to enter the market.


What the rules against these food trucks do is work to reduce the competition in the market and they violate the basic liberty of those individuals, to serve others in a voluntary manner; those who are willing to exchange for the product.

Court Rules: Stop The Food Truck Ban

In Fort Pierce, Florida, food truck owners there are upset with the same issue and have been engaged in the same battle for their freedom, and just recently a Florida Circuit Court ruled that the Fort Pierce region must stop enforcing their unconstitutional food truck ban.

These food truck owners are paying for the same permits, licenses, inspections etc, as other food establishments in the local market, and they want to compete just the same.

The law in that region had banned food trucks from operating within 500 feet of any restaurant or business that is selling food, but that sort of business restriction has been deemed unconstitutional repeatedly when challenged in court.

Nearby where I live the amount of food trucks is insane. I never would have thought that would be the new trend in Tennessee. I think local laws here have made it easier for food truck owners to start-up. Town leaders like to keep town structures the same and historic so I guess allowing food trucks keeps the town nicer. Better than mowing historic buildings down for a chain restaurant.
