From the results of research that has been author lakukakan, it can be concluded as follows:

The profit sharing agreement between toke boet and fishermen in Baktiya Barat subdistrict is motivated by economic factor of people who do not have enough capital to own their own boats, unfortunately toke boet which sometimes has some boats so it requires fisherman to work for him.

In the partnership, toke boet (ship owner) handed the boat to the fishermen represented by the handler (nahkoda) and also the toke boet provides the overall capital for the operation of the sea as for oil, boat maintenance, the cost of eating, drinking and curing the fishermen, part (1/3) for toke boet and 2 parts (2/3) for fishermen divided equally for the whole fisherman after the previous catch of fish is cut in total capital that has been issued by toke boet.

The profit sharing agreement between the fishermen and the toke boet that occurred in Baktiya Barat subdistrict is only verbal and there is no written cooperation contract.

The profit sharing agreement between toke boet and fisherman in Baktiya Barat subdistrict is not in accordance with syara 'guidance because in the system of cooperation for the result of mudharabah the losses incurred are borne by the owner of capital as long as the loss is not due to the negligence of the manager, but what happens is the opposite loss is borne by fisherman. In the view of Islamic economic ethics, the share of fish catch where in case of loss is borne by fishermen contrary to Islamic economic ethics which emphasizes justice in economic cooperation and such practices including injustice to fishermen.

Suggestions

Based on the results of the research, the authors can provide some suggestions that can be used as material consideration of the implementation of the fish catch between toke boet and fishermen in Baktiya Barat District:

It is expected that the ship owner (toke boet) should in cooperation agreement for the catch of fish with fisherman should execute it according to Islamic law mentioned in akad mudharabah ie if there is loss which is not caused by negligence of fisherman then the loss is borne toke boet so as not to menzalimi fisherman

To the public should be able to study and understand various forms of cooperation in order to meet the needs of daily living in accordance with the principles of sharia, not only limited to the mudaraba agreement and is expected to the scholars provide legal counseling about the system of true profit sharing according to Islamic law so that people can know the economic system allowed by Sharia (Islamic law) and can practice it in everyday life.

BAGI HASIL ANTARA TOKE DAN NELAYAN

Dari hasil penelitian dan pembahasan yang telah diuraikan pada bab terdahulu, maka dapat diambil kesimpulan sebagai berikut:

Akad bagi hasil tangkapan ikan antara toke boet dan nelayan di Kecamatan Baktiya Barat dilatarbelakangi faktor ekonomi masyarakat yang tidak memiliki cukup modal untuk mempunyai kapal sendiri, adapula toke boet yang sudah berkecukupan bahkan terkadang memiliki beberapa kapal (boet) sehingga memerlukan nelayan untuk bekerja padanya.

Dalam kerjasama tersebut toke boet (pemilik kapal) menyerahkan kapalnya kepada nelayan yang diwakili pawang (nahkoda) dan juga toke boet menyediakan keseluruhan modal untuk operasional melaut seperti untuk minyak, perawatan kapal, biaya makan, minum dan rokok nelayan, dengan pembagian hasil yaitu: 1 bagian (1/3) untuk toke boet dan 2 bagian (2/3) untuk nelayan yang dibagi sama untuk keseluruhan nelayan setelah sebelumnya hasil tangkapan ikan dipotong keseluruhan modal yang telah dikeluarkan oleh toke boet. Akad bagi hasil antara nelayan dan toke boet yang terjadi di Kecamatan Baktiya Barat hanya sebatas lisan saja dan tidak ada kontrak kerjasama secara tertulis.

Akad bagi hasil tangkapan ikan antara toke boet dan nelayan di Kecamatan Baktiya Barat tidak sesuai dengan tuntunan syara’ karena dalam sistem kerjasama bagi hasil mudharabah kerugian yang terjadi ditanggung oleh pemilik modal selama kerugian itu bukan akibat kelalaian pengelola, namun yang terjadi adalah sebaliknya kerugian ditanggung oleh nelayan. Menurut pandangan etika ekonomi Islam, bagi hasil tangkapan ikan dimana bila terjadi kerugian ditanggung oleh nelayan bertentangan dengan etika ekonomi Islam yang menekankan keadilan dalam kerjasama ekonomi dan praktik tersebut termasuk kezaliman terhadap nelayan.

Saran-saran

Berdasarkan hasil penelitian, maka penulis dapat memberikan beberapa saran yang dapat dijadikan bahan pertimbangan terhadap pelaksanaan bagi hasil tangkapan ikan antara toke boet dan nelayan di Kecamatan Baktiya Barat:

Diharapkan kepada pemilik kapal (toke boet) hendaknya dalam kesepakatan kerjasama bagi hasil tangkapan ikan dengan nelayan hendaknya melaksanakannya sesuai hukum Islam yang disebutkan dalam akad mudharabah yakni bila terjadi kerugian yang bukan disebabkan kelalaian nelayan maka kerugian tersebut ditanggung toke boet sehingga tidak menzalimi nelayan

Kepada masyarakat luas hendaknya dapat mengkaji dan memahami berbagai bentuk kerjasama dalam rangka memenuhi kebutuhan hidup sehari-hari yang sesuai dengan prinsip-prinsip syariah, tidak hanya terbatas pada akad mudharabah dan diharapkan kepada alim ulama memberikan penyuluhan hukum tentang sistem bagi hasil yang benar menurut hukum Islam sehingga masyarakat bisa mengetahui sistem ekonomi yang dibolehkan oleh Syariah (hukum Islam) dan bisa mempraktekkannya dalam kehidupan sehari-hari.
