NO-CONFIDENCE MOTION ACCEPTED IN LOK SABHA
WHAT IS A NO -CONFIDENCE MOTION ?
According to the rules of the Indian Parliament ,a government must always have majority support in the Lok Sabha in order to remain in power.
If a member of the house feels that the government does not enjoy this majority ,then they can move a ‘no-confidence’ motion .If the motion is accepted ,then the onus is on the government to defeat the motion in order to prove its majority in the house.
Vote -The motion is then put to vote; it can be conducted through “Voice Vote” , “Division of Votes” or other means .
The government of the day has to resign if the government loses a ‘confidence ’ motion or if the ‘no-confidence’ motion is accepted by the majority.
There is no time-limit that must be adhered to between two no-confidence motions.
WHAT IS THE PROCEDURE ?
Once introduced ,a debate on the motion takes place only if 50 or more MPs rise in support of it . At the end of such a debate , the motion is put to vote.
UNDER THE RULE
WHO CAN PROPOSE A NO-CONFIDENCE MOTION ?
As per Rules 198 of the Rules of procedure and conduct of Business in Lok Sabha, any member of the house can move a no-confidence motion.
The member has to give a written notice of the motion by 10am to the Secretary General of the LOk Sabha on any day of sitting. If a notice is received after 10am , then it considered as being received on the next day sutting .
The member does not need give a reason for moving a no-confidence motion.
HISTORY
Acharya Kripalani moved the first -ever no cofidence motion on the floor of the Lok Sabha in August 1963, immediately after the disastrous India -china war. (failed)
Prime Minister Indira Gandhi faced the most number of no-confidence motions- 15times
With the anti-defection law, the vote of no-confidence has no relevance left in case the majority party has an absolute party (with an absolute majority in the House) issues a whip to party member s to vote in favor of the Government, then it is impossible to remove the Government by a no-confidence motion.
NUMBER OF STRENGTH
In a house of 535member, the ruling National Democratic Alliance has 313 members in the Lok Sabha including 274(including the speaker)of BJP,18 of Shiv Sena, six LJP and four SAD.The stated strengh of the Opposition is 222, including 63 of the Congress-led UPA, 37of AIADMK, 34 of TMC,20 BJD,16TDP and IITRS.
Shiv Sena leader sanjay raut had said the party was undecided on supporting the no-confidence motion that the TDP sought to move in parliament. The comments from Raut, whose party shared testy ties with BJP,came a day before the beginning of the Parliament’s Monsoon Session.
