ويحرم على الرجل ولو مجبوبا وخصيا وعنينا ومخنثا وهما نظره إلى أجنبية مشتهاة حتى إلى وجهها وكفيها ظهرا وبطنا, وهو المفتي به, لكن نقل عن الأكثرين حل النظر إلى ذلك. أما نظر الرجل إلى زوجته وأمته في حال حياة كل منهما فجائز ولو مع وجود مانع من الإستمتاع قريب الزوال كحيض ورهن, لكن يكره نظر الفرج حتى من نفسه بلا حاجة, بخلاف المانع البطىء الزوال كأن اعتدت الزوجة عن شبهة, فيحرم النظر إلى ما بين سرتها وركبتها , دون غيره كالمحارم والأمة المزوجة. أما النظر لإجل النكاح, فيجوز إلى الوجه والكفين فقط من الحرة, وإلى ما عدا ما بين السرة والركبة من الأمة. ويجوز النظر إلى الأجنبية في الوجه فقط للشهادة والمعاملة, وإلى الأمة عند شرائها فيما عدا العورة من ظاهر البدن.
Unlawful for a man even if he does not have a genitals, castrated, impotent or sissy, sees the ajnabiyyah woman musytahat (entering the age of ablution by touching it) either looking at his face or his two palms, the outside and the inside. As for husbands to look at their wives or slaves, the law may be permitted even if his wife or his slave is forbidden for a special 'as in the case of haidh and in mortgage to others (especially slaves), but makruh the law sees the genitals even though it is his own without any intent. As for seeing a free woman for the purpose of marrying then allowed to see the face and two palms of his hand only. As for seeing the female slave, it is allowed to see other than the limbs between the navel and knee / knee. And may see the face of ajnabiyah women for a testimony (shahadah) and in mu'amalah.
ويجوز النظر إلى الأجنبية ومسها للمداواة في المواضع التي يحتاج إليها ولو فرجا, بشرط حضور من يمنع الخلوة من محرم ونحوه, وبشرط فقد جنس معالج, ويجوز النظر إليها أيضا لتعليم الواجب فقط عليها كما قاله السبكي وغيره, وذلك عند فقد من يعلمها من المحارم والنساء, قياسا على المداواة, وعند تعسر التعليم من وراء حجاب. ولا يجوز النظر إليها لأجل تعليم المندوب, بخلاف الأمرد, فيجوز النظر إليه لأجله. كذا المصري على الغاية لأبي شجاع.
It is permissible for men to see ajnabiyyah women in medicine, and may also touch the limbs that are being treated with her walnut (her cock) on the condition that there is a mahrom nearby and no doctor / female physician again.
