That doesn't even come close to fair use. Some people are under the false impression that if you cite the source, that is considered fair use. That is not what fair use is. What that user is doing is straight copyright infringement for the purpose of profit.

To be considered fair use, there has to be a good reason to use the photos of others. For example, if you wanted to critique them.

How in the world did you get the impression that citing a source was fair use? Misinformation like that is irresponsible to spread.

Don't worry, I'm not conflating the two things. The photos were copied. Only the creator has the right to copy them. The right to copy = copyright.

I do understand what you are saying though. A DMCA would have to come from the copyright holder, no matter how much we complained about it.

Using solely someone elses pictures to make money, not even in a part of an article, is definitely not "fair use". And you as a copywriter should know that.

Steemit is very complex in that regard, because you don't actually make "money". You mine blocks. It's not quite clear yet. You have to file a complaint under DMCA, so the only parties allowed for griveance are the people portrayed in the photos. And Tumblr itself.

While the user hasn't done any transformative work or what not, he/she does curate the photos. Which, unless someone files a complaint, he/she is allowed to do that according to Steemit.

And where would those people file the complaint to when there is no real authority on the platform? They would first have to join, either pay or wait two weeks, and then jump through hoops of getting a sense of the platform and complaining to steemcleaners etc.

The girls can alwas file a complaint @ steemit support, but I wouldn't hold my breath.
