I think it's more of a moral question.
If they have rights, will they be prosecuted if guilty of any form of offence?

Excellent question. Morality is a tight rope walk for humans, and in our thousands of year of existence it still confounds us. Robots, who are built on math and logic, I wonder what morality would mean for them.
