CPS strip searches to be challenged at the Supreme Court.

So-called "child protection" "services" (CPS) is finally being challenged at the U.S. Supreme Court for one of their most notorious and onerous practices...the strip searching of little children (and some times older ones.) While, of course, the justification is that they are looking for evidence of abuse, but I can tell you FOR SURE that the practice of having a stranger rip your clothes off is every bit as abusive (or more so) than any spanking any child might have received, prompting a CPS "intervention."

While most states have not yet proscribed mild corporal punishment in law, CPS, of course always thinks they know better; and, whenever possible, they will use any mark of bruising--no matter how slight--as a mark against innocent parents. Never mind that many children get bruises for a whole variety of reasons having nothing to do with their parents, or other family members or caretakers. Of course, there are also those marks that are left by genuine abuse, but those cases are rare, and CPS know it. There is nothing subtle or ambiguous about a child being strip searched--often without the parent's consent or knowledge.

"At issue is the disturbing practice of child welfare investigators to strip-search children alleged to be victims of abuse, without a warrant and without parental consent. The Foundation urges the High Court to take the case and to rule in favor of a child’s privacy, according to the brief.

In the current case, I.B., a 4-year-old-child, was subjected to such a search, euphemistically called a “body check,” while attending preschool in 2014. The mother (“Jane Doe”) learned of the invasion only weeks later when her daughter asked, “Mommy, do you remember when the woman with white hair came to my school? I hope she doesn’t come again, because I don’t like it when she takes all my clothes off...Children who endure strip searches commonly display similar symptoms to sexual abuse victims.”

The Parental Rights Foundation is behind the brief filed this week with the U.S. Supreme Court after the mother's case was decided in favor of CPS by the Tenth Circuit in Denver. This, despite the fact that even the loony toons Ninth Circuit had already decided that such strip searches were/are a violation of a child's civil rights.

Thus, we have a case that will provide a final resolution to the opposing judgments of two previous federal circuit rulings. As such, this case has the potential to establish precedent that could last for a very, very long time. Please do go and support the efforts of PRF...

So has the US Supreme Court AGREED to hear the case? When will it be heard? Interesting. With more conservative judges there is hope. Thanks for sharing.

I am not sure if they've gotten that decision yet, but, of course, SCOTUS deciding not to hear it would also be an answer. Not a good one, but...
